1. Grant of License
Cybersonix grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Cybersonix mobile application and associated services solely for your personal, non-commercial use, subject to these terms.
2. Restrictions
You may not, and you may not permit any third party to:
- Copy, reproduce, or duplicate any part of the Cybersonix software or platform
- Modify, adapt, translate, or create derivative works based on the software
- Distribute, sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the software
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software
- Remove or alter any proprietary notices, labels, or marks on the software
- Use the software to build a competing product or service
- Use the software in any manner that violates applicable law
3. Intellectual Property
The Cybersonix name, logo, software, platform, and all associated intellectual property are the exclusive property of James Colbourne. Nothing in these terms grants you any right, title, or interest in the software beyond the limited licence expressly stated above.
4. No Warranty
The software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Cybersonix does not warrant that the software will be uninterrupted, error-free, or free of harmful components.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Cybersonix or James Colbourne be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the software.
6. Termination
This licence is effective until terminated. Your rights under this licence will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the software and destroy any copies in your possession.
7. Governing Law
This licence shall be governed by and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions.
